SQE1 Mitigating Circumstances: What Candidates Should Know
While most candidates sit SQE1 without difficulty, performance can occasionally be affected by issues arising at the test centre that are outside a candidate’s control. Where this occurs, the SRA’s mitigating circumstances policy exists to address such situations.
Mitigating circumstances are defined in paragraph 2.1 of the policy, and the claims process is administered by Kaplan on behalf of the SRA. The policy and guidance are available here:
Mitigating Circumstances Policy
Candidates considering a mitigating circumstances claim should be aware that strict time limits apply. Under paragraph 4.3 of the policy, claims must be submitted by 4.00 pm (UK local time) on the fifth working day following the relevant assessment date, using the prescribed form referred to at paragraph 4.2.
In practice, claims submitted outside this timeframe are routinely rejected, regardless of their underlying merit. It is therefore essential that candidates familiarise themselves with the policy and act promptly if they believe a claim may be necessary.
